Agreement for Using JuaExpress

Acceptance of Terms

By accessing or using JuaExpress (juaexpress.com), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our platform. These terms apply to all users, including buyers, sellers, and visitors. Last updated: December 31, 2025.

Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must be at least 18 years old to create an account. Notify us immediately of any unauthorized access.

User Conduct

You agree to use JuaExpress only for lawful purposes and in accordance with these Terms. You will not use our platform to: violate any laws or regulations, infringe on intellectual property rights, transmit harmful or fraudulent content, interfere with the platform's operation, impersonate others, or engage in any form of harassment or discrimination.

Buyer Terms

As a buyer, you agree to: provide accurate shipping information, pay for purchases in a timely manner, not abuse our return/refund policies, communicate respectfully with sellers, and report any issues through proper channels. Purchases are protected by JuaExpress Purchase Protection when using our approved payment methods.

Seller Terms

As a seller, you agree to: provide accurate product descriptions, ship items within stated timeframes, comply with all applicable laws and regulations, not list prohibited items (counterfeits, illegal goods, hazardous materials), and maintain professional communication. Seller fees and commission rates are outlined in our Seller Agreement.

Intellectual Property

All content on JuaExpress, including logos, text, graphics, and software, is the property of JuaExpress or its licensors and is protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Prohibited Items

The following items are strictly prohibited: counterfeit or stolen goods, weapons and explosives, drugs and controlled substances, adult/explicit content, items that violate intellectual property rights, hazardous materials, and any items illegal in the buyer's or seller's jurisdiction.

Payment Terms

All prices are displayed in the respective local currency with conversion estimates available. Payment processing is handled by secure third-party providers. Funds are held in escrow until order completion. JuaExpress is not responsible for currency fluctuation between order placement and payment processing.

Limitation of Liability

JuaExpress is a marketplace platform connecting buyers and sellers. To the maximum extent permitted by law, we are not liable for: seller actions or product quality, transaction disputes beyond our Purchase Protection scope, indirect or consequential damages, service interruptions, or third-party content. Our total liability shall not exceed the fees paid by you in the preceding 12 months.

Indemnification

You agree to indemnify and hold harmless JuaExpress, its affiliates, officers, and employees from any claims, damages, or expenses arising from your use of the platform, violation of these terms, or infringement of any third-party rights.

Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the platform ceases. Provisions that by their nature should survive termination (intellectual property, limitation of liability, indemnification) shall remain in effect.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use after changes constitutes acceptance of the new Terms.

Governing Law & Disputes

These Terms are governed by the laws of Kenya. Any disputes arising from these Terms or your use of JuaExpress shall first be resolved through our internal dispute resolution process. If unresolved, disputes shall be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya, unless otherwise required by law in your jurisdiction.
